Terms of use
Last updated 24 October 2026
These terms are the agreement between you and KiwiDrive, a service run by a New Zealand sole trader ("we"). They apply when you use this website or the app, and when you buy a pack of practice tests. You accept them by ticking the box at checkout or by using the service. Questions? Email support@kiwico.online.
What you buy
- A pack of full practice tests in the KiwiDrive web app. One payment gives you the number of tests in the pack you choose (10 or 20 tests). Each test has 35 questions and is timed like the real theory test.
- A test is used when you start it. A test you leave or that runs out of time still counts as used. Tests never expire: there is no time limit on using them. Your dashboard and the review of your past tests stay available after you've used them all.
- You get the tests of the pack whose price you paid. To get more, buy any pack again with the same email address: the new tests are added to your account and your progress carries over.
- It is for your own personal use: one account per person, used by that person only.
Price and payment
- The price of each pack, in New Zealand dollars, is shown in the pricing section of this site and at checkout (see the pricing section). The price at checkout is the price you pay.
- It is a one-off payment. There is no subscription, nothing renews and nothing to cancel.
- Payment is taken by Stripe on its own secure page. We never see your card details.
- If a payment reaches us at an amount that doesn't match one of our packs (for example through an out-of-date link), we will contact you to put it right or refund it.
No GST charged — we are not GST registered.
Delivery and your account
Your access is emailed straight after payment (see delivery). Your account is the email address you paid with: there is no password, and you sign in with a link or a 6-digit code we email you. Keep that inbox secure, because anyone who can read it can sign in as you. If you typed the wrong address at checkout, email us and we'll move your tests to the right one.
Refunds and your consumer rights
Our refund policy gives you a full refund within 7 days of a purchase if you have started fewer than 2 tests since it. That sits on top of your rights under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986, which nothing in these terms limits or excludes. If the app doesn't work as it should, those rights may entitle you to a remedy at any time.
An unofficial practice tool
KiwiDrive is not affiliated with, endorsed by or produced by NZ Transport Agency Waka Kotahi, which sets and runs the real theory test. Our questions are for practice and are not the questions used in the real test. We work to keep them accurate and in line with the official New Zealand Road Code, and we correct mistakes when we find them, but the Road Code is the source of truth and we recommend you study it as well.
We can't guarantee you a pass in the real theory test. Your practice scores and the readiness signal on your dashboard are a guide to your own consistency, not a prediction. Passing depends on you.
Acceptable use
- Don't scrape, bulk copy, download, record or republish the questions or pictures.
- Don't use bots, scripts or other automated tools to access the app.
- Don't try to get around the app's security, probe it for weaknesses or access anyone else's account.
- Don't share, lend, resell or transfer your access.
The app, its design, its software and its content are protected by copyright and other intellectual property law. You may use them only for your own practice. If an account breaks these rules we may suspend or close it, and we won't refund tests that were used.
Availability and changes
- We aim to keep the app available at all times, but a small service can't promise that. There may be short outages for maintenance or problems outside our control. A test in progress during an outage is scored as it stands when its 30 minutes run out, as in the real test; if an outage on our side costs you a test, email us and we'll put it back.
- We may improve the app and update these terms. The terms shown here, with the date at the top, are the current ones. A change never shortens or takes away tests you have already paid for.
- If we ever close KiwiDrive down, we will email you at least 30 days before, and if you still have unused tests from a purchase we will refund the part of that purchase they represent.
Ending your account
You can stop using KiwiDrive at any time, and you can ask us to delete your account (see our privacy policy). Deleting your account also removes any unused tests. We may close an account that breaks these terms.
Liability
Nothing in these terms limits or excludes any right you have under the Consumer Guarantees Act 1993, the Fair Trading Act 1986 or any other law that can't be excluded. Beyond that, and to the extent the law allows, we aren't responsible for loss that doesn't result directly from our breach of these terms, and our total liability to you is limited to the amount you paid us in the year before the claim. We aren't responsible for the result of your real theory test, which depends on you and is run by NZTA.
New Zealand law
These terms are governed by the laws of New Zealand, and New Zealand's courts and tribunals (including the Disputes Tribunal) handle any dispute. If you have a problem, please email us first; we would much rather sort it out with you directly.
